Lilly is seeking an attorney with advertising law experience, preferably in the life sciences industry, to support Lilly’s centralized commercial and consumer operations, as we seek to modernize the way we interact with patients and HCP customers in an increasingly digital world. This attorney will work closely with the Sr. Director, Assistant General Counsel Commercial/Consumer Operations to shape Lilly USA LLC’s transformation efforts. Specifically, this attorney will be a strategic business partner to the Consumer Experience Hub (CEH) and Global Commercial Services (GCS) as Lilly continues its journey to be a more data-driven, customer-centric organization. This role requires an attorney with significant experience working with marketing and advertising teams and media arrangements, in both traditional advertising channel and innovative digital spaces. This attorney should have legal expertise in applicable law pertaining to marketing, advertising, and branding. This attorney will need to counsel the teams on various legal matters including, but not limited to, FDA labeling and advertising requirements, the Anti-kickback Statute and its safe harbors, the False Claims Act, antitrust law, unfair competition law, consumer protection, data rights and privacy, FTC Regulations and Guidelines, marketing and advertising law, commercial law, and business transactions. The position will report to the Sr. Director, Assistant General Counsel Commercial/Consumer Operations.
Specific activities may include the following:
Assisting the Sr. Director, Assistant General Counsel Commercial/Consumer Operations in supporting Lilly USA LLC’s central capabilities, providing legal counsel to the Commercial Operations and Consumer organizations.
Serving as day-to-day strategic business and legal advisor to the Commercial Operations and Consumer organizations, including support of the following:
Data Optimal Utilization Guidance (DOUG) Governance Committee
Customer Support Program Review Board (CSPRB)
Lilly USA LLC sponsorships and promotional partnerships
Development of policies, procedures and playbooks for new initiatives across CEH and GCS
Omnichannel/MarTech design (medical and marketing)
Digital and social media platforms
Customer Support Programs and Patient Support Programs
Field reimbursement team
Providing end to end counsel to Lilly USA’s Media Team in deploying new media strategies, tactics and programs. Work with cross-functional colleagues (including regulatory and ethics and compliance) to develop playbooks formalizing enterprise guidance for new media initiatives and campaigns.
Providing guidance and support as GCS develops tools and capabilities to advance omnichannel engagements, use of data analytics to drive organizational decisions, content intelligence, and modernization of sales and marketing competencies.
Advising on patient support and other programs consistent with healthcare fraud and abuse laws.
Coordinating with privacy and data security teams to ensure compliance with internal policies as well as external laws and regulations
Coordinating with copyright, trademark and IP counsel to ensure appropriate and consistent application of legal requirements
Juris Doctor degree from accredited school
Current license to practice law in at least one of the fifty states; eligible to be admitted to the bar in Indiana
A minimum of 5 years of relevant legal experience either practicing as a member of a law firm or government agency in a relevant area of law, in house at a pharmaceutical or biotechnology company’s law department, or a combination
Qualified candidates must be legally authorized to be employed in the United States. Lilly does not anticipate providing sponsorship for employment visa status (e.g., H-1B or TN status) for this employment position
Working knowledge and understanding of pharmaceutical marketing laws and regulations as generally practiced by innovative, multinational pharmaceutical manufacturers
Expertise in media law or experience counseling in the advertising, digital and social media arena
Day-to-day experience negotiating and drafting commercial agreements, preferably in the area of media sales and promotion/marketing partnerships
Practical experience with digital technology, social media, and streaming products
Experience working with sophisticated parties in the media and advertising space
Familiarity with data analytics and business intelligence processes
Familiarity with privacy, data protection and consumer protection laws
Demonstrated ability to advance strategies and tactics
Demonstrated ability to advise on complex commercial agreements
Strong organizational skills and ability to manage multiple priorities in a fast-paced and evolving environment
Strong analytical skills and ability to craft innovation solutions to complex issues, focusing on simplicity and practicality
Ability to drive integrated solutions by partnering with cross functional colleagues in a highly matrixed organization
Demonstrated learning agility
